TWO men from Nkulumane 5 suburb in Bulawayo pleaded not guilty to stealing their friend’s property comprising a television, AV codes, jacket and an Open View decoder.
Lucky Mufundirwa (22) and Malvin Mathe (23) appeared before Western Commonage magistrate Shepherd Mjanja facing a charge of theft as defined in Chapter 113 of the Criminal Law (Codification and Reform) Act Chapter 9:3.
The pair pleaded not guilty to the charge and was remanded in custody to 7 March for continuation of trial.
Allegations against the duo are that on 4 January at around 9pm, Craig Siziba (19) left his home going to his other friend’s place and came back the following day at around 7am.
When he returned home, he discovered that his flat screen television, a red bat green jacket, AV codes and an Open View decoder were missing. Siziba then noticed Mufundirwa’s shoe prints in the yard.
He then went to Mufundirwa’s house where he discovered his red bat green jacket.
He reported the matter to the police and investigations led to the duo’s arrest.
When the court asked Siziba why he was accusing Mufundirwa of stealing his property he said he saw his shoe prints from his yard and when he went to his house, he also found him in possession of his missing red bat green jacket.
Mufundirwa, however, defended himself saying the shoe prints Siziba found in his yard were not his. Mufundirwa also told the court that he got the jacket from their other friend only identified as Antony.
The court further heard that Mathe was not in Nkulumane when the incident took place and when Siziba was asked why Mathe was arrested he failed to link him to the commission of the crime.
